These Terms govern your use of the GoalNexis app for iPhone and iPad, published on the Apple App Store by Emre Karaduman ("we", "us", "our").
The Android app is published by a different developer and has its own terms: GoalNexis for Android terms.
By downloading, installing or using the App you agree to these Terms. If you do not agree, do not use the App.
GoalNexis publishes football match forecasts, accumulator selections (several predictions combined into one) and statistical analysis. It is an information and entertainment service.
Some content is labelled VIP. VIP content is the part of the App that requires a paid subscription; everything else is free.
GoalNexis is not a betting service. You cannot place a bet, deposit funds, or win money in the App. The App is not connected to any bookmaker, betting exchange or gambling operator, and we receive no commission from any of them. The only money involved is your subscription, which is charged and collected by Apple.
No prediction is a guarantee. Football is unpredictable and any forecast can be wrong. Past accuracy does not indicate future results. Any decision you take on the basis of content in the App is yours alone, and you bear the consequences of it.
You must be at least 18 years old, or the age of majority where you live, whichever is higher. By using the App you confirm that you meet that requirement.
You are responsible for making sure that using an application of this kind is lawful where you live. Gambling, and content related to gambling, is restricted or prohibited in some countries, and it is your responsibility to know the rules in yours.
GoalNexis has no accounts. There is no registration, no login and no password. Your subscription is tied to the Apple ID you bought it with and is managed there.
Because there are no accounts, we have no way to link a purchase to anything other than the Apple ID that made it. Your subscription restores on any device signed in to that same Apple ID. It does not transfer to the Android app, which is sold separately by a different developer — if you switch from an iPhone to an Android phone you will need to subscribe again, and the unused part of your Apple subscription is not refundable, so cancel it before you switch.
GoalNexis offers auto-renewing subscriptions that unlock VIP content. Free content remains available without a subscription.
You may cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.
Cancel in Settings › your name › Subscriptions, or through your Apple subscriptions page.
Deleting the App does not cancel a subscription. You must cancel through Apple.
Refunds are handled by Apple under its own policy, not by us. Request one at reportaproblem.apple.com. Where the law of your country gives you a statutory right to cancel or to a refund, that right is unaffected by anything in these Terms.
If you reinstall the App or move to a new device, open the subscription screen and tap Restore Purchases. This restores any active subscription bought with the same Apple ID. It cannot restore a subscription bought with a different Apple ID or on another platform.
If we decide to discontinue GoalNexis we will give at least 30 days' notice through the App Store listing, stop taking new subscriptions and turn off auto-renewal, and you will keep access for the billing period you have already paid for.
The analysis, forecasts, text, design and software in the App belong to us or to our licensors and are protected by copyright and other intellectual property rights. Club badges and competition logos remain the property of their respective owners and appear only to identify the fixtures being discussed.
Your subscription buys you a personal, non-transferable right to view the content in the App. You may not:
The App has no comments, uploads, posts or any other user-generated content. Nothing you do in the App is published or visible to anyone else. If you email us, you keep ownership of your message and we use it only to answer you.
You agree not to use the App for any unlawful purpose, not to attempt to gain unauthorised access to our systems, not to interfere with the App's operation or security, and not to access it by automated means.
The App is provided on an "as is" and "as available" basis. We do not promise that it will be uninterrupted, error-free or always accurate, and we may change, suspend or discontinue any part of it. Content is published daily but we do not guarantee a fixed number of predictions on any given day.
To the fullest extent permitted by law, we are not liable for:
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, these Terms do not affect your statutory rights.
Subject to that, our total liability to you is limited to the total subscription fees you paid for the App in the twelve months before the claim arose — whether those fees were paid to us or to Apple on our behalf.
If betting is affecting your finances, your relationships or your wellbeing, help is available. In the UK, GambleAware lists free, confidential support, and the National Gambling Helpline, run by GamCare, is on 0808 8020 133, 24 hours a day. In Turkey, the Ministry of Health's Yesilay counselling line is on 115. Most other countries have an equivalent service.
The App relies on services operated by others, including the Apple App Store and the providers listed in our Privacy Policy. Their own terms and privacy policies apply to their part of the service, and we are not responsible for their content or practices.
Because the App has no accounts, we have no way to block an individual user. Where these Terms are breached — in particular where VIP content is redistributed — we may take other steps available to us, including reporting the account to Apple and pursuing the breach through the courts.
You may stop using the App at any time by uninstalling it and cancelling any subscription through Apple.
We may update these Terms. The date at the top of this page shows when they last changed, and material changes will be noted in the release notes on the App Store. Continuing to use the App after a change means you accept the revised Terms.
These Terms are governed by the laws of the Republic of Turkey, and the courts of Istanbul have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer law of your country of residence, nor of the right to bring proceedings there.
If any part of these Terms is found to be unenforceable, the rest continues to apply. These Terms are the whole agreement between us about the App.
We may transfer our rights and obligations under these Terms to another business — for example if we incorporate or sell the App. If we do, your subscription and these Terms continue on the same footing and we will tell you beforehand. You may not transfer yours.
